Taking care of improving the demographic situationin Russia, in recent years, the government pays special attention to the problems of increasing the birth rate and all kinds of support for large families. 9 years ago, the second child in the family meant a big risk and was overlooked by the overwhelming majority of Russians. The situation has changed dramatically with the adoption of the law on maternal capital for the second and subsequent children. And after a few years, many mothers consider it natural to have at least two or three children. Such a mood pleases, letting one hope that the country will not allow a demographic catastrophe. Measures in the field of social support for large families, i.e. those parents who raise three or more children. The most popular was the law, according to which land plots for large families are allocated.
Starting with the idea of the governor of the Ivanovo region,who supported the large families with land for land for the construction of housing on a grant basis, with the support of the President of the Russian Federation Medvedev DA in its annual message to the Federal Assembly in 2010, the State Duma developed and adopted the Federal Law. According to the Law of June 14, 2011 No. 138-ФЗ “On Amendments to Article 16 of the Federal Law“ On the Promotion of Housing Construction ”, lots of large families are provided to solve housing problems by building a house on federal or municipal property.
The procedure for obtaining land, as well as the size of plots are established by specific laws adopted by the subjects of the Russian Federation, already at the local level.
The law was immediately noted by a majoritylarge families in various parts of Russia. However, almost immediately there were situations when the adopted law was not supported by local legislation, designed to regulate the process of obtaining land. Ambiguous signals began to come in when land plots to large families were allocated both in prosperous territories supported by infrastructure and unsuitable for families with minor children.
Moreover, local legislation is oftenonly hampered the implementation of federal law. First of all, land for large families is not so simple. At the local level, their own restrictions are being imposed, which impede the receipt of a plot. In some areas, along with a statement from a large family will be required to provide a certificate of family income. If the total income is higher than the established standard, the local authorities have the right to refuse to accept the application. Also, in order to exercise their rights under federal law, the age limit is introduced - children in the family must be under age, the family should not have other land owned, parents in a large family must live at the place of request for at least a certain period.
In the Moscow region that period must exceed 5years, and in the capital - at least 10 years. A significant number of large families who have recently moved to another place of residence are deleted from the list of eligible potential landowners.
However, the first year of operation of this lawshowed its relevance, since applications for land plots to large families are no longer counted by units, but by hundreds of thousands. Moreover, many families have already received and started the construction of new houses, and a program of state support exists through the crediting in banking structures for building work. Of course, this law will not solve all the problems that a family faces with three or more children, but there is a fact - the state needs new citizens, and it takes measures to increase the population of Russia.
