The regulatory framework of the resettlement program in St. Petersburg
The implementation of the program “The resettlement of communalapartments ”in St. Petersburg (2016 and previous years) is regulated by a number of legislative acts and regulatory documents, the earliest of which, determining the reasons for the need to implement the program, but not the stages of its implementation, is dated 2004. The main issues directly related to the target program are regulated by the law of St. Petersburg “On the target program ...” dated 2007. The last document describes in detail the mechanisms for implementing the resettlement procedure, requirements for participants, documents and other features. Another project, with the help of which it was planned to end communal apartments, the city authorities implemented in 1998-2003.
The objectives of the implementation of the program for the resettlement of communal apartments
The resettlement of communal apartments (2016-2017)carried out in order to improve the living conditions of citizens of St. Petersburg, who are in the list of those in need. Thus, the city authorities seek to ensure only single-family settlement of the apartment, which, of course, will affect the general level of life of citizens.
State assistance under the program

- providing families with housing from the state housing stock;

How the resettlement program works: 5 ways
There are five ways to implementState program "Settlement of a communal apartment." Most of them are implemented without attracting investors, but the option with the participation of legal entities is also present. So, the apartment settlement is represented by the following interaction options:
- Residents of a communal apartment under the contractsales pass the rooms to a single buyer and acquire their own (separate) housing in the secondary market. Families are assisted in finding and purchasing apartments.
- One of the families living in the apartment being settled in, acquires rooms from other tenants - neighbors. Thus, the apartment becomes a separate housing.
- In the event that the apartment already has oneor several vacant rooms, or those vacated as a result of improved living conditions for other tenants, a family can buy out a living space at a price lower than the market value. The price of the purchased room can be up to 70% of the market and depends on the period of registration of the family as a person in need of improved living conditions.
- There is also a mechanism for the redistribution of housing, exchanges in order to ensure the settlement of the apartment by one family.
- Attracting investors to conclude an agreement on the resettlement of a communal apartment and the further implementation of the program according to the signed document.
Participation if tenants have reached an agreement regarding the settlement
In the event that tenants were able to reach agreement on the feasibility of participating in the program, the resettlement of a communal apartment is carried out according to the following scheme:
- You must obtain the consent of all registered residents to participate in the state program.
- Each adult tenant shouldsubmit an application to the authorized bodies to include a separate communal apartment in the list and submit a package of necessary papers (which documents are required below).
- Administration after reviewing applications and documents informs residents about the decision.
In the future, tenants have the right to claim social benefits in order to improve the existing housing conditions. To get paid you should:
- submit an application for social benefits and the necessary documents to the MFC or structural subdivisions of “Housing and communal services”;
- the authorized organization generates a list of citizens applying for receiving payments, determines the sequence and approves the list;
- after updating the data, the Housing Committee of St. Petersburg makes the final decision regarding the accrual of social benefits;
- the organization informs the tenants about the possibility to receive money, after which the persons apply for receiving payments.
Participation if tenants do not reach agreement with neighbors
If the tenants do not reach agreement with their neighbors,the resettlement of a communal apartment is carried out in a similar way, however, people who seek help in improving living conditions cannot claim priority payments.
So, it is necessary:
- Apply to the authorized bodies with a statement and a package of necessary documents.
- Wait for information on the results of the examination of the package of papers.
- In the event of a positive decision of the Housing Committee should apply for receipt of payment.
In cases where the agreement withabout the settlement changes during the consideration of documents, it is necessary to inform the Housing Committee. This fact will allow to have the primary right to improve living conditions compared with citizens who have not reached an agreement with their neighbors.
Package of documents
The program of settlement of communal apartmentsprovides for a specific procedure for the provision of documents (which was outlined in general above for two cases) and a specific list of required papers. So, in the MFC or territorial subdivisions of the “Horticolation” it is necessary to provide
- application for inclusion of a specific apartment in the list;
- copies of papers confirming the identity of the applicant (s) and their originals to verify compliance;
- a document with information about family composition and a copy;
- documents confirming the ownership or use of the dwelling.
Papers are submitted family-wise and are accepted only when the originals are submitted for checking the authenticity of the copy.
The procedure for calculating payments
Payments are provided to participants of the program “Settlement of communal apartments” in St. Petersburg. Cash payments can be used:
- to purchase a separate apartment on the secondary housing market;
- to purchase a room, if the latter is purchased in addition to the occupied one;
- to participate in the construction of a house or apartment, provided that it is at least 70%;
- for payment of a share;
- to pay the cost of the assignment of rights for shared construction.
Purchased housing must be located onthe territory of the Leningrad region or in St. Petersburg and can not be less than that provided by the standard of residential security for all family members. The subsidy “Settlement of communal apartments” can not be used to purchase housing that is considered unfit for life, does not meet the requirements, or is pledged.
